Guatemalan President Otto Perez Molina has begun the process of renewing the mandate of a valuable United Nations-backed anti-impunity organization, easing fears about his commitment to judicial reform in the country.

President Perez made good on his promise to support the two-year renewal of the International Commission against Impunity in Guatemala (CICIG) yesterday, meeting with CICIG head Francisco Dall?Anese in the presidential palace in order to outline the renewal process (link in Spanish). According to Perez, renewing the mandate isn?t very complicated, and only consists of exchanging a few letters with UN Secretary General Ban Ki-moon.

The CICIG?s current mandate expires in September 2013, but the renewal will add two more years to this deadline. Apart from the extension, Perez told local press that the administration will develop a ?road map? of the Commission?s objectives for the next several years, which will be presented to the countries funding the project.

As InSight Crime has noted previously, the CICIG has proved to be extremely effective in the struggle to fix Guatemala?s broken justice system. Because of its importance to the prospect of judicial reform in the country, Perez raised eyebrows during his presidential campaign last summer after he dodged questions about renewing the Commission?s mandate. He further fueled concerns about his dedication to cleaning up the judicial branch when he distanced himself (link in Spanish) from the work of the country?s ambitious Attorney General, Claudia Paz y Paz.

However, it seems Perez has decided to keep on both the CICIG as well as Paz y Paz, which have continued their active pursuit of government corruption cases, as a series of recent high-level prosecutions illustrate.

Tortilla Factory Owner Arrested Over Business Practices

The owner of a Brooklyn tortilla factory where a worker died after falling into a mixing machine has been arrested on charges of underpaying employees, falsifying business records and violating workers? compensation and unemployment insurance laws, the authorities said on Wednesday.

The owner, Erasmo Ponce, faces 26 felony counts and 23 misdemeanor counts, according to a complaint filed in Brooklyn Criminal Court by Eric T. Schneiderman, the state?s attorney general. Mr. Ponce surrendered to the authorities on Tuesday and was arraigned and released without bail, his lawyer said.

Mr. Ponce, a Mexican immigrant, declined to comment on the charges, but his lawyer, Manuel Portela, said he did not think the case merited criminal prosecution.

?We?ve been trying to resolve this case on an administrative level,? Mr. Portela said, adding that his client ?wants to resolve it and move forward in a way that is fair and equitable.?

Mr. Ponce?s company, Tortilleria Chinantla, has been operating under the investigative glare of state and federal officials since Jan. 24, 2011, when Juan Baten, a Guatemalan worker at his tortilla factory in Bushwick, died after falling into a large machine used to mix tortilla dough. Mr. Baten was crushed in the machine?s churning mechanism.

Several days later, state officials shut down the factory after discovering that the company had been operating without workers? compensation insurance for nearly a year.

The state eventually allowed the factory to reopen, but in July 2011, the federal government cited the company for workplace safety violations carrying fines of more than $62,000. The most serious violation, deemed ?willful,? involved the failure of the company to install a barrier on the mixer to prevent employees from coming into contact with its fast-moving machinery.

Ted Fitzgerald, a spokesman for the federal Occupational Safety and Health Administration, which conducted that investigation, said Wednesday that the tortilla company had contested the citations and penalties and that the case was still pending.

Mr. Baten?s death and the ensuing investigations have darkened the reputation of Mr. Ponce, whose life had followed the classic trajectory of the striving, up-by-the-bootstraps immigrant.

Mr. Ponce was poor when he moved to the United States from Mexico in 1989 and, after a few years of doing manual labor and saving money, he started a small tortilla-making vending business in New York. Within a decade the company grew into a national enterprise with revenue of several million dollars a year.

His success made him one of the wealthiest and most influential members of the city?s growing Mexican diaspora, and he burnished his reputation by donating to various social and political causes in the New York region and in Mexico.

While he declined to speak on Wednesday about the new set of charges against him, Mr. Ponce chatted enthusiastically about a ceremony he was hosting on Saturday to christen a new mural on his factory?s facade. It depicts a workers laboring in a cornfield, he said, and has been popular with the neighbors.

?I am working well with the community,? he said.

A sudden increase in narcolepsy in Finnish children at the beginning of 2010 was likely related to the Pandemrix vaccine used in response to the H1N1 2009 flu pandemic, according to two reports published Mar. 28 in the open access journal PLoS ONE.

The authors of the studies, led by Markku Partinen of the Helsinki Sleep Clinic and Hanna Nohynek of the National Institute for Health and Welfare in Finland, found that the average annual incidence of narcolepsy between 2002 and 2009 among children younger than 17 was 0.31 per 100,000, and in 2010, this incidence was about 17 times higher, at 5.3 cases per 100,000. In contrast, the incidence rate for adults over 20 was essentially unchanged over that same time period.

To further evaluate the potential connection between the vaccine and narcolepsy, the researchers collected vaccination and childhood narcolepsy data for children born between January 1991 and December 2005.

They found that the narcolepsy incidence for vaccinated individuals within this age group was 9.0 per 100,000 people, as compared to just 0.7 per 100,000 for unvaccinated individuals almost 13 times lower.

Together, these results provide compelling evidence that the Pandemrix vaccine, used in 2009 and 2010 in association with the H1N1 flu pandemic, contributed to narcolepsy in patients between the age of 4 and 19 in Finland, the authors conclude.

North Texas Airline Passengers Stranded By Stormy Weather

DALLAS (CBSDFW.COM) ? The wet weather directly impacted air travelers at Dallas/Fort Worth International and Dallas Love Field Airports.

Flight delays and cancellations had travelers stranded for hours.

Air passengers attempting to ravel by air from Dallas? Love Field Airport lugged around carry on baggage and tried to hold on to their patience.

Chelsea Averill should?ve arrived in Albuquerque on Monday, but the college law student sat stuck, grounded by rainstorms, with hundreds of others.

?Actually, this was my second [attempt to leave]. I was trying to get home in two days. My flight yesterday was canceled, because they had high winds there. Maybe it?s a sign I?m not supposed to be living here,? she said laughing.

Averill?s good-natured attitude about the ordeal wasn?t isolated.

The storms of Monday forced an airport full of people to simply make do with the circumstances that included flights delayed for hours and others cancelled completely.

In all, some 35 flights at DFW Airport were canceled and others delayed.

Love Field also had dozens of cancellations. Allison Ralston was still trying to get to Lubbock on Tuesday morning.

?There was a lot of people waiting here overnight, so obviously it?s kept [the weather] a lot of people here, ? she said. ?I know there were four flights from Houston Hobby, and we?re all just sitting together.?

By 6 a.m. Tuesday the dozens of flights cancelled and delayed were finally given the green light and hundreds of folks, who had been waiting, were finally given clearance to begin trips to their destinations.

The airport clearance also meant travelers with Dallas Love Field as their destination, were able to finally arrive.

World stocks mixed as Greece outweighs US recovery

BANGKOK (AP) ? World stock markets were mixed Monday as doubts about Greece's ability to follow through with tough economic reforms required under an international bailout overtook good news about the U.S. economy.

Benchmark oil rose fell below $107 per barrel while the dollar was higher against the euro but lower against the yen.

Britain's FTSE 100 fell 0.4 percent to 5,941.15. Germany's DAX dropped 0.6 percent to 7,114.64 and France's CAC-40 lost 0.7 percent to 3,568.63.

Wall Street was poised to fall, with Dow Jones industrial futures down 0.3 percent to 13,130 and S&P 500 futures slipping 0.3 percent to 1,294.30.

Debt-loaded Greece recently qualified for a second multibillion dollar bailout after its private creditors took significant losses on their bond holdings to avoid losing even more money in a Greek bankruptcy. Now, new doubts are emerging about whether Greece will be able to deliver on austerity promises that were part of the bailout deal.

"Officials remain concerned about the ability of Athens to politically deliver on the tough economic-overhaul policies, especially considering that the forthcoming elections in Athens may mean new leaders aren't as committed to reforms," Stan Shamu, market analyst with IG Markets in Melbourne, Australia said in an email.

In Asia, Hong Kong's Hang Seng Index fell 1 percent to 21,115.29 as falling home prices in China and its weak trade in the first two months of 2012 kept investors' verve in check.

New home prices dropped in 45 Chinese cities in February, the official Xinhua News agency said, the result of government policies intended to cool property speculation.

Evergrande Real Estate Group lost 3.7 percent, and Industrial & Commercial Bank of China, the world's biggest bank by market value, lost 1.5 percent.

Further evidence from the U.S. last week that its economic recovery is gaining strength buoyed stocks elsewhere in Asia. The U.S. is a crucial market for the region's exporters.

The Dow Jones industrial average is up 8.3 percent this year, and the Nasdaq on Friday broke through 3,000 for the first time since the dot-com days more than a decade ago.

Japan's benchmark Nikkei 225 finished higher for the fifth session in a row and recorded its highest close since a disastrous earthquake and tsunami on March 11, 2011. The index gained 0.1 percent to 10,141.99.

South Korea's Kospi index added 0.6 percent to 2,047 and Australia's S&P ASX/200 rose 0.3 percent to close at 4,290.80. Benchmarks in Singapore, Taiwan and Indonesia fell.

In mainland China, the benchmark Shanghai Composite Index gained 0.2 percent to 2,410.18. The Shenzhen Composite Index rose 1.1 percent to 993.75.

Benchmark oil for May delivery was down 32 cents to $106.74 per barrel in electronic trading on the New York Mercantile Exchange. The contract rose $1.95 to finish at $107.06 per barrel.

The euro fell to $1.3153 from $1.3171 late Friday in New York. The dollar fell to 83.08 yen from 83.36 yen.

PRIMARY PURPOSE : To analyze complex or technically difficult claims to determine benefits due; to work with high exposure claims for appropriate line of business (LOB); to ensure ongoing adjudication of claims within company standards, industry best practices and specific client service requirements; and to manage subrogation of claims and negotiate settlements.

ESSENTIAL FUNCTIONS and RESPONSIBILITIES

Analyzes and processes complex or technically difficult claims by investigating and gathering information to determine the exposure on the claim; manages claims through well-developed action plans to an appropriate and timely resolution.

Assesses liability and resolves claims within evaluation.

Negotiates settlement of claims up to designated authority level.

Calculates and assigns timely and appropriate reserves to claims; monitors reserve adequacy throughout the life of the claim.

Calculates and pays benefits due; approves and makes timely claim payments and adjustments; and settles claims within designated authority level.

Prepares necessary state filings within statutory limits.

Manages the litigation process; ensures timely and cost effective claims resolution.

Coordinates vendor referrals for additional investigation and/or litigation management.

Uses appropriate cost containment techniques including strategic vendor partnerships to reduce overall cost of claims for our clients.

Manages claim recoveries, including but not limited to subrogation, Second Injury Fund recoveries and Social Security offsets.

Reports claims to the excess carrier; responds to requests of directions in a professional and timely manner.

Communicates claim activity and processing with the ill or injured party and the client; maintains professional client relationships.

Ensures claim files are properly documented and claims coding is correct.

Refers cases as appropriate to supervisor and management.

ADDITIONAL FUNCTIONS and RESPONSIBILITIES

Performs other duties as assigned.

Supports the organization's quality program(s).

QUALIFICATIONS

Education & Licensing:
Baccalaureate degree from an accredited college or university preferred. Licenses as required. Professional certification as applicable to line of business preferred.

Experience
Four (4) years of claims management experience required. BS/BA degree may substitute for two (2) years of required experience.
